My first question is was it an AMA field???

There are rules we must follow to help keep this hobby safe...

Stuff does happen but reckless flying is not acceptable...

In the yoyo player community, if you hit someone with your yoyo while playing/demonstrating, it's proper ettiquete to give them the yoyo you hit them with.

Sounds like a good deal for helis too.

My friend is just learning also and he gets tired of me yelling at him to get the heli away from us when hes flying, he keeps bringing it in to within 7 to 10ft and a 50 size scares the crap out of me when it gets close. I told him he can fly that close when he is at home but when hes with me to keep it away.
I hope you get some nice new birds from this guy

Just remember the idea is not to "reward" yourself for having the misfortune of getting hurt but make the rat who ran his heli into you with intentional recklessness to pay enough to make him not want to hurt anyone again. Absolutely amazes me that he has no concept of remorse for opening up flesh on someone else.

I'm no a lawyer but I'll bet that both the guys portrayed in this thread could be held accountable for "reckless endangerment" by state and federal prosecutors because of the warnings in the build instructions which they chose to ignore. I know you can't legislate common sense but I think you can hold someone to account for bodily injury, especially permanent.

...yep...

I agree someone who flies a heli into someone else is an idiot.
If he did so reckessly then he should be charged.
~But
Now the guy is charged with assault with a deadly weapon.
why is that such a good thing?
Do you want r/c helis to be classed as deadly weapons, and then to try and get 3rd party insurance to fly these "deadly weapons" that have been known to go out of control? Do you want to try and get cover and permissions to have public displays of deadly weapons flying about?

Is a big claim on your association 3rd party insurance something to rejoice about, and for everyone to congratulate the victim on the potential windfall of $$$$? What is the premium gong to be next year? Will insurance be available, and if not will there be anywhere you can fly?

I'm not saying the irresponsible pilot shouldn't pay, if truely liable then he should pay and even be locked up.

But compensation should be just that, enough to cover what you lost(earnings, medical fees etc).

I think heli is not a weapon (as car isn't either?) but surely deadly.

Not sure whether 'locked up' is good way to deal with such guys. I think he will get out *worse* instead of better. How about psychiatric check and withdraw all licences he isn't up to (eg how about his driving licence, do you want such guys in the traffic?)

I'm not buying this story. The guy was "arrested" for assault with a deadly weapon? But you said it was an accident? If true, and he was a reckless flyer, I doubt he would be arrested. And the first thing you talk about is suing to get more heli's? None of this sounds legit. Prove it and show the police report, some pics etc.

What happen to talking, or even arguing about the situation? I am not trying to down play it, just trying to remind us all to remember to work things out as individuals first. Maybe the guy was just having a really off day, maybe he did not know better. The way he was after the accident, could be a result of the accident itself. You don't know, give him a chance to make it right.

I am sorry for your accident and pain, but I feel it was just a accident. I have see many accidents over the years at the flying field that have involved cut fingers, arms, and legs. I have see airplanes (helicopters) clear the pit area and make people stumble and fall. These situations have occurred from seasoned members and new members just the same. I think we all assume a certain amount of risk at the flying field.

The club officers need to be invovled and review the situation. Is there any type of policy at the field that states all new club memebers have to go thru a saftey check and a review of the saftey rules? Getting lawyers involved is only going to hurt the individuals, the club and the landowner. They never stop at just... they go for it all.

Just my 2 cents.

BS ... Flag on the play!

1. Where did this occur?
2. Sounds like a kid talking.
3. Sounds abit far fetched, I'm not buying in on this until pics are shown or a police report. Even if pics of a cut leg are shown, who's to say you didn't fly your Blade 400(8) into your OWN leg.

It has happened before! (Need I mention FOO)

Read his description of the story, he almost wrote the thing without stopping to use a period. Sounds like a kid to me also.

My Suggestions, Act Quickly First......

1. Find out this guys name, address and AMA Number if he has one.

2. Go to the Yellow Pages and leaf through the section on "Lawyers", it will be about an inch thick. Find the biggest ad you can. It will probably have a photo of the top partner and some hot young para-legal. Call that firm make an appointment for a consultation as soon as possible.

3. Contact the AMA by email or phone and report the incident exactly as it happened and also forward them a copy of any paperwork you received at the Emergency Room. I'm not saying they're going to do anything about it but at the very least they should know of the incident and who was responsible.

4. Please share with us where this guy is from in Pennsylvania. I live in the state and would certainly like to know of his location.

Most importantly though, I hope you heal well with no complications and someday you may be able to tell the story to others without the thought of pain as what stands out the most.

Get Well Soon!

Respectfully,
Ed

Glad you are OK.

File a lawsuit against him. Just call a lawyer and tell them what happened. Your guaranteed to win 100%. Take him for all he is worth.
