My milli was hit by a plank at a public flying site at the weekend

I was hovering at 20 feet, some 40 metres away which was some 15 metres the other side of the strip. This jerk flies flat out down the strip and smacks the heli.

Not only was his flying piss poor but his attitude was well out of order and the matter nearly resulted in physical contact. However, I wanted to know if anyone had successfully claimed against a third party for this type of incident.

In the UK, being a BMFA member I automatically carry 3rd party cover so presumably if I was to damage someone elses property they could/should claim against me. Should I be entitled to do the same in this instance? Anyone tried this?

When you rack up the costs, its a significant claim, and thats without my time to carry out the rebuild......

What public site was this?
I\'ve seen some appalling flying safety at public sites, specially the Wormwood scrubs site.
There\'s no way I\'d fly any of my helis at any of those uncontrolled places.

Hi Janek,

Thanks for the commiserations, I heard a while ago about a guy who turned on his tx without checking frequencies and caused a crash. The other guy was compensated through his bmfa insurance, so I thought that this may have established the precedent for claims of this nature which involve negligence.

My reasoning is, if he had hit my car, or me, I\'d be claiming against him, so why not my heli?

The site in question was Epsom Downs. For some time I\'ve had my reservations about flying here, but convenience and habit have kept me coming back. My 2 fears were being midaired, or god forbid, a failure, mechanical or dumb stick that resulted in an injury. Well, I see this as the first warning and I\'m not going to carry on till the latter occurs, so I\'m seeking out another private site for the heli stuff.

Ordinarily I would just accept it as a knock for knock thing, but the guy\'s behaviour was so out of order I feel incined to drag him through it. In the past he\'s tried to fly at helis so I think this may have been pre empted.

Saw your OS70 at Bob\'s the other day......it hasn\'t failed again has it?

Hey Rog,

(I assume it\'s Roger with the big ass Cap the other week - John with the Fury here) After seeing how busy it was the other weekend I\'ve vowed to myself never to fly at Epsom Downs ever again at a weekend. No pegboard, two shoot downs in one day, people miscalculating frequencies and turning on.. ..I too am seeking a private club in the area and will checking a few out this weekend, it\'s amazing no-one has been injured up there yet.

I\'m pretty sure the BMFA insurance only covers damage to people not property, yep - just checked BMFA website. Is Epsom Downs even a sanctioned BMFA flying site? I doubt very much you\'ll get anything out of them.

BMFA insurance used to exclude member-to-member damage, so you\'re on your own. Mid-airs are usually considered to be both pilots\' fault, though I can see that a fast-moving plank and a stationary heli could be viewed differently. Good reason for staying away from mixed sites, especially public ones.

Ever been to Hanworth Air Park at the weekend? Used to get a mid-air almost every week there, but that was some years back, they may have cleaned up their act by now.

Makes me glad I left the country!

Really? They used to advertise with a picture a smashed car windscreen asking if you could afford to replace it. Has the policy changed? I haven\'t been a member for the last 6 years.

Well, update for you, I spoke with the bmfa and they confirmed that I can make a claim against this flyer and that he should make a consequent claim from his bmfa cover (if he has it..), and that subject to the circumstances I could be compensated.

The cover is not just personal injury, it is also property, but purely on a third party basis. I\'ll let you know what happens.

John, Yes it is me with the Edge 540, I\'m going through the same exercise with sites - lets compare notes. Agree with you totally about the safety, this has really prompted me to get off my arse and sought out a proper site.

How many thousands of gallons have gone through OS 61s 32s etc.. with no probs? Glad you had good service from irvine, I found them to be totally useless, the only time they offered me anything comparable to service was when I started hassling them.
