NA Runryder I need your help!

I agreed in October of 06 to purchase a $2000 shipped heli Ion from sjferrozzo from this thread:

We agreed that I would pay by credit card, but then I asked him if I could pay by check since my card was maxed. Unfortunately I decided I couldn't afford the heli and asked him to find another buyer. It then sold pretty quick on the thread.

The problem is that the $2000 was charged to my credit card and hasn't been refunded. It took the credit card company like 6 months to find out who made the charge since I wasn't sure where the $2000 charge came from (thinking that it was never charged by sjferrozzo). I was also surprised that Scott didn't refund the money without being asked since he clearly sold the heli to another buyer.

After repeated attempts recently, I have not heard back from Scott. From his other threads he seems very reputable.

All I want is the $2000 that I paid to be refunded. Any ideas?

Since it's an unauthorized charge, your credit card company will remove the charge if you call them and let them know. It's up to the seller to prove the charge is legitimate. The burden of proof is on him. I know some credit card companies will ask you to call the seller in good faith to resolve the issue but ultimately they should side with you. I suggest you write a letter to your credit card company detailing exactly what happened and how you tried to resolve the issue(document everything as it maybe important later on). Calling them sometimes gets you nowhere and I am speaking from experience.

Scott thanks for posting here! And no, this is no scam.

My credit card got charged the $2000 from that purchase. And no refund was ever applied.

My credit card copmany (Citibank) won't dispute the charge since its over 90 days old.

Scott, since you won't return my PM's or call me, can you post here on these 3 questions:

--- Did you charge my credit card $2000 - Yes or no?
--- Did you then sell the heli to another person after I told you I couldn't buy it - Yes or no?
--- Did you refund the $2000 to me after that - Yes or no?

The answers as I see them as Yes, Yes, and No. Please respond so we can clarify the situation.

If you don't plan to refund the money, I will have to file a complaint with the FTC, the IC3, and the St Paul Police Department.

I'd just like to call the whole thing a misunderstanding and wrap it up.

Not trying to get in the middle or anything but for the guy who
posted the year old PMs, having saved them that long had a pretty
good idea that this transaction would come back and haunt him!
Just my thoughts though not that anyone cares what I think.

I am still waiting for Scott to answer those 3 questions above, here.

Also in the post Scott shared above, there is an exchange that Scott removed (that I can share, but didn't post here as it has his phone number). It is in between 9-15 10:16pm where he told me to call him, I did, gave my credit card.

He charged the $2000 under his company's merchant account (I've spoken with them) however he doesn't work there anymore (for a reason that I won't post but let's just say its not favorable). He apparently was the CEO.

If anyone is wondering why it took this long to bring it back up, my wife was monitoring the credit card payments for a while and this one slipped through. We were doing a major remodel at the time and Scott's company's name sounds like a housing purchase. It took the credit card company months to give us more information after we found the purchase and another several months to decline the charge back.

At this point verticalflight is on the good guys list several times so I would have to say hes the honest 1 here. Seems like there is so much scamming is going on here now. I think anymore heli's I buy better be very close by that way I go get the heli I bought if someone tries to scam me.

Its a real shame this type of thing happens whoever is to blame. I have been hearing about alot of scamming going on, not only here but on other sites also. It is going to deter many new pilots from getting into this hobby. But I guess there are alot of low life thieves on other hobby/interest sites.......Z

Vertical Flight, contact the company that the credit card charge went to. Establish that they actually received the funds and then find out what they did with them, whether they infact turned them over to sjferrozzo or what? If they didn't do that then you might be able to get them to refund the money to you.

It sounds like it's possible since sjferrozzo didn't think you were buying the heli that he may not have thought the money was coming and might never have asked the company to give it to him.

It's possible a transaction can just be lost in the mileau of many company transactions and nobody has even noticed it for whatever reason. Also, if sjferrozzo has a bad relation with the company now he may not want to be in contact with them.

If the company is above board and they can establish that they received the funds but it wasn't for any good or service that was rendered and they didn't disperse them to sjferrozzo, then they should be obliged to return the funds.

For what it's worth, it's worth a try, if you haven't already followed up on this line of reasoning. Keep a positive attitude and hopefully things will ultimately work out OK. I'll be hoping with you.

PM him and told him i had pay pal do a search and no transactions for 2000 as or ever had been made for that kind of money i told you to send proof and i would look in to it . 2nd i have every transaction i have ever did on r/r i have not deleated them dose that make me a bad guy but this is a transaction over a year ago and you told me you were sending me cash.....then the next day you backed out of the deal . i told you to prove i got the money because pay pal has no recored.

Scott you used your company's merchant account to process my Cititbank Mastercard. It wasn't via Paypal. The merchant account that processed the purchase is http://www.bioguardplastics.com/ and the amount was $2000 on the same day I gave you my credit card. They are based where you live. Plus I called them and they said you used to be the CEO but aren't any longer.

Where am I misunderstanding?

I keep all transactions for the same reason(I'm just to lazy) I hope everything works out and I would def. contact the company in question. what it sounds like to me is just a big mis-understanding. and both partys are feeling a little bad. good luck to both of you and I hope it gets straighten out.
