If you have been scammed by David Yates, and want to get in on a lawsiut I am filing against him, let me know. I do appriciate what our buddy fran is trying to do, but I don't know what the police can do for us, this will most likely turn out to be a "civil matter", and I know this from dealing with this kind of situation before.I also know this will take just about forever. Things like this take time. However, once we get a judgement against him, as long as he has a job, the courts will garnish his wages, even if he refuses to pay us. I am in contact with a lawfirm in Ohio, and am prepared to drive down there for the court appearences, and I will not ask anyone for any money, Mr. Yates will also be sued for legal fees and expences, so if you want in on this, drop me a PM. Lets get this guy.

Wow, the ground was closer than I thought.

Good going, I did not loose anything to this scumbag so I've kept quiet. But I have followed the story. This jerk has stolen from several members and successfully BS'ed his way around for several months without getting even with anybody. It's time to stop wasting time. The trouble is if he gets away with this he will keep it up and the next one he screws might be me or you. If he had any intention of making things right it would have been done by now. Go Get Him. He's a Thief.

Fran, you have already done a bunch, all we can do is hope the police can help you. In my situation, I think what the police can do is limited to my word against his, but I did get a bunch of stuff together to fax in in the AM.

Wow, the ground was closer than I thought.

Yes, it is my Trex, and I believe it was sold already, and it took him a while to ship it, too.

It would be a lot cheaper for most of you guys to just file a small claims against this guy. Going into limited jurisdiction or unlimited or even class action would just make lawyers richer. You guys are going to suffer the cost of lawyer fees, court fee's, filing fees, service fee's, jury fee's, and not to mention collection fee's. By the time everything is said and done, you woulda spent more money on the case then its worth. Good luck getting your money if he files bankruptcy.

I'd suggest you just file small claims, get a judgement, then give it to a collection agency to collect. Much easier, cheaper, and faster. Each person would have to do this on their own. If you all sign up together, then you all will have to share the legal cost.. Then I'd just have to call all you fools , a fool.

Well its understandable you wanna fry the guy but wait till you see the bill from the lawyers... Do it through small claims.. You'll be better off and the net effect will still be the same.
