RE:David_Yates, Ripped off or not - you decide

PS this is being posted here because it has to do with trading/buying and selling from a fellow RR member - I am hoping that this might help get the gyro that I have been waiting over 5 weeks delivered to me.

Ok, here goose:

I am not one to outright call someone a liar or cheat - not until I could back up the claim. But here's a brief situation, you tell me if you think I got ripped off and if you would be mad as hell over it or not.

About 5 weeks ago I had a couple radio's up for sale. Was contacted by David_Yates on this forum and offered a 401 gyro for the radio set and case that I had advertised. I told him I would think it over as I was needing the money more than anything due to a work injury and cut in pay as a result of it. After a couple days he contacted me stating that he really needed the radio because "My son knocked my heli radio off the dresser and broke it" and "I just want to get back in the air". Being a dad myself and heli guy I agreed and thought I could help him out and get a back up gyro in the trade.

Next day I sent the TX/RX and case off to him priority 2 day delivery so that he could have it before the weekend. **Poof** he disappears for about 10 days and I cant get a response from him via several Emails and PM's.

Then I see that he has included the very radio I had sent him with another guys heli add (a "buddy of his" - his words I belive) (here's a link to the add)
http://www.runryder.com/helicopter/...=david_yates#RR) .
After about 20 PM's sent to him I send a email asking
"> Hi david_yates
>
> Where is the 401 gyro - or was there ever one to
> start with? I haven't received it and you wont
> respond to my emails/PM's - I hate to pas such
> judgment but I am assuming your just another scammer
> or con artist? If not then you should take a second
> to respond to people while making such transactions
> - instead of acting like you have been."

I received a message back (a bit to my surprise) that he had been called out of town for a death in the family (great - I felt like a ass then) and " no I am not a scammer buddy, I am all over the good guy list. I am out of town and can not log in to rr for some reson. I am glad you e-mailed me I will be back tomorrow afternoon and your gyro will be out then. I am very sorry for the mix up, I had the box laying out out just forgot to mail it." This was back on the 27th of June.

Ok, this seems plausable - so I sent the following:
"David, I am sorry to hear about the recent events - and unplanned trip. I have sent 3-4 pm's to you but they went unanswered (RR showed they had been read though). And I had not received the gyro. I hope you can understand why I was starting to think I had been ripped off. I am glad you have emailed me back though - at least I understand now what is going on.
Again, I hope you can understand why I was starting to think I had been scammed and I hope you will accept my apologies."

He later explained that the PM's were read on his cell phone but that it would not let him reply and that he could not log into RR from a computer at his current location - but that he could respond to my email from that location.

Ok guess it could happen.............

After a couple days and a few PM's/emails I got a reply that the Gyro had gone out in the mail. I asked several times for a tracking # or something showing that it had been sent out and got no response. After a week or so and no Gyro I again started sending Emails and spamming PM's.

On the 5th of July I sent the following :
"David - according to the last email I received you stated "I just got home and will be sending the gyro today and will e-mail you with the tracking number." - That was 6 days ago and Now again I have not heard from you and the couple PM's I have sent have gone unanswered. Please send me a update, this is getting very old and once again it appears that I'm being dodged or something here. Lets get this issue cleared up so we can be done with it."

I received a reply that he thought it should have been here by now and that he would check with the post office to find something out. (Again I asked 4-5 times for a tracking # and got nothing)

On the 7th I received the following
"Hi,
Post office couldn't tell me anything, so I just
yanked a 401 off my rex and will sent that out and the
another MO, all I ask is if the other one shows up is
to please send it back to me, as I am no down a 401.
Please send me you address again and I will send
priority with delivery confirmation and tracking number.
Thanks,
David"

I sent my address and asked that I be given the tracking #......... now 8 days later and too many emails and PM's to count I have received nothing in response and nothing in the mail.

Let me hear what you all think - if anyone knows David personally I would like to know if this sounds like him or what is going on here. I never had a bad deal until this one and I dont know. Maybe I am being conned or maybe David has worse luck than me. I'm not saying hes a liar or a thief - just trying to lay the facts out and let me hear what you all think.

As my dad would have said "If you lay around acting like a dog - expect to get some fleas".

I could post all the emails sent and PM's sent and the few that were received but it would take up 10 pages at least and i really don't want to go through each one and edit out phone numbers and addresses and such.

David if your reading this then feel free to toss your defense in here - I already told you that I am not calling you a thief or con but I think I have asked for very little and gotten even less in this deal. Provide me a tracking number or a emailed scan of the money orders you say you have sent. Respond to my emails and PM's do something to resolve this issue.

OK, so it won't fly any better but it looks damn good on my shelf. Bling-Bling!

I'm in your corner...

he didn't waste any time getting intouch with you to get what he needed...it's like someone who borrows money from you and says they'll pay you on payday; but after payday comes and goes and you finally run them down; here's the famous statement, "Oh! I couldn't get back to you; I lost your number, etc???". To which I say; "you didn't have trouble finding me when you wanted something...why now is it you've forgot who I am and try to make it out it is my fault!!".

I think you're right on with your concerns and doubts. I just don't understand how people can do such things and act like it is YOUR FAULT they did them!!!!

Keep us posted on this situation!

Trades

Trades are dangerous. Had 3 so far and all worked out fine, but that can happen to anyone. In trades I always ask to speak in person from a home phone to home phone. If they don't want to give it out, then that is a sign and watch out.

Perfect practice makes perfect

Hey man,

I was the one that was selling the raptor that David threw in the RD6000, the heli never sold and he still has the radio as far as I know, I haven't been able to get a hold of him as he cancelled his nextel number and that was the only number I had. If I see him I will tell him he needs to set things straight, I don't condone his actions and I don't know the whole story, but since he lives close to me I will try to get him to set this deal straight. However keep me posted and I will watch this thread.

Thanks

thank you!

thank you Adam -

I would appreciate any help you could provide. I have tried to be understanding with him and I have tried to be sympathetic to him but every time I turn around I get "blown off" - I would just like to get the gyro as we had agreed or the radio back - or payment for the radio.

please please keep me posted - being part of the military system I have access to some (more or less) free legal resources, and at this point I plan on going down when I can next week to see what they can do to help me - I know one of the military lawyers in particular who is always on the look out for someone (weather it be a person or company) that is out to fleece GI's.

Please keep me informed if you can find anything out.

Why do people always do this nonsense?
They make it harder for everyone else to do business!

tbcseod,
I hope your deal is cleared up and that you get your merchandise!

Wow, seems like you were takin for a ride bro. If i were you am gonna make a copy of all the pm's and take it to your local police and file a complain. They will help you out..I too was taken for a ride before, traded my MBX 5 for a heli but the heli didnt make it to my house. He said it was in the mail..2 weeks, 3weeks,4 weeks pass, nothing..pm's was ignored, phone number replaced.. I took all the evidence i have like pm's, email, the receipt for sending my trade, etc. etc. to my local sherrif. My local police contacted his local police regarding the matter and in about a 2 weeks i got the heli with extras..It took that long but at least i got it..Good luck..

I feel your agony. I been threw this a few times. I had a expensive 450 mile trek to beat on a door to get my heli after a long wait with no communications after sale. He may be using the gyro since he has a radio now or just one of those disorganized deadbeats that just can't make it to the shipping department.

David_Yates! Send this man his sh-t before heli blades start falling on ya.
